Indian Defence Minister Manohar Parrikar told Parliament on Wednesday that the procurement process was circumvented in the purchase of 12 VVIP helicopters from AgustaWestland UK.
Parrikar was replying during a debate on the alleged corruption charges in the purchase of VVIP helicopters by the Indian Air Force (IAF) in 2010.
Last month a Milan, Italy, court ruled that the $553 million AgustaWestland contract for buying VVIP helicopters from Italian company Finmeccanica, signed in 2010, involved payoffs to Indian officials.

India's former Defense Minister A.K. Antony demanded that AgustaWestland and parent company-Finmeccanica should not be allowed to participate in any of the future “Make in India” projects.

The Indian air force has a dilemma.
It has sought for years to procure new helicopters to transport the country’s president, political leadership and visiting heads of state.
But the 2010 scandal over the purchase of a dozen AgustaWestland AW101s is still shadowing the mission.
As a result, the air force is running out of options.
The latest wrinkle emerged when an Italian court ruled that India had not fully cooperated with an investigation into alleged kickbacks paid to secure the purchase of 12 AW101 transport helicopters.
The scandal brought the $530 million deal to a halt in 2013.
At the time the deal was scrapped, three of the 12 AW101s had been delivered.
All three now sit mothballed in a hangar at Palam air base in New Delhi, awaiting the result of an international arbitration between AgustaWestland - now owned by Leonardo-Finmeccanica - and the Indian ministry of defense.
That leaves the Indian air force without dedicated VVIP helicopters for one of its principal tasks in the nation’s capital.
The service has officially told the government that an interim arrangement made in 2013-14 is not sustainable indefinitely.
Anticipating the crisis, the air force modified 11 newly delivered Russian-built Mi-17 V5 medium-lift helicopters for VVIP duties, adding a luxury cabin, safety features and air conditioning.
A handful of those are deployed now, with more to join later this year.
A senior air force officer stresses that a permanent solution is needed.
“It had been decided that [Mi-17 V5s] would be deployed only as a bridge to a full procurement or replacement,” the officer says.
“The Mi-17s are medium-lift helicopters specifically ordered for military logistics and transport missions.”
The service is moving cautiously.
It cannot be seen to be pushing too hard for a fresh procurement, especially since a former chief of the air force is a suspected recipient of bribes in the 2010 scandal.
Also, given that the AW101 procurement was made, in part, to give the air force’s VVIP squadron bigger and higher-performance helicopters than its erstwhile Mi-8 type, deploying the similarly sized Mi-17 is barely a step forward.
“The [Indian air force] can make a case to procure 11 more Mi-17s for operational duties. That is not the problem. But closing the door on a replacement for the AgustaWestland machines is a step back in the overall modernization process. VVIP transport is high risk. We need the best we can get, not just ‘souped up’ helicopters,” the officer says.
Unofficially, the service knows that the prospect of a fresh procurement of VVIP helicopters at this time - or in the foreseeable future - is virtually impossible.
India has had a notorious history of political arms scandals, making new procurement an extremely risky process.
India’s most famous arms scandal, the 1986 Bofors scam, has prevented the country from adding a single piece of artillery to its army for 30 years.
A similar scandal involving German submarine-maker HDW blocked India from license-building a submarine for nearly three decades as well.
Political infighting has seen to it that arms scandals usually put a stop to whatever the country is trying to modernize.
A similar situation could bedevil the air force’s historic VVIP transport wing.
Manufacturers such as Airbus Helicopters and Sikorsky remain cautious.
Neither is making overt offers to the Indian government.
A senior Sikorsky official in India revealed that the company had brought up the possibility of leasing a small fleet of S92 VVIP transports to the air force to “tide over the crisis.”
But the heat of the AgustaWestland case ensured discussions never really progressed.
That has not stopped Sikorsky from showing off a model S92 in Indian air force VVIP squadron colors at every Indian defense show for the last few years.
Airbus Helicopters, which fielded its EC225 Super Puma in the original competition, prefers to wait and watch.
Off the record, officials at both companies admit that a fresh competition at this stage is India’s least likely path forward.

In a fresh development in the AgustaWestland chopper case, Defence Minister Manohar Parrikar, in an interview to The Indian Express, said that Italian company Finmeccanica is banned from participating in any new defence procurement.
Finmeccanica is currently under investigation for charges of bribery in the AgustaWestland VVIP chopper deal.
The newspaper quoted Pakkikar as saying, "Finmeccanica is banned from participating in defence procurement. I cannot ban it from doing something else if it wants to. In defence we don’t buy equipment from some countries for security reasons, but I don’t stop that country from selling smart-phones in India."

After virtually freezing all defense business with Italy, the Indian Ministry of Defence (MoD) has begun exploring alternatives to meet its dire weaponry requirements.
In an unexpected move, MoD has dispatched Defence Secretary G Mohan Kumar to Germany to actively participate in the 10th annual India-German Higher Defense Committee Meeting, according to an MoD source.
The event began June 13 and concludes Wednesday.
“We are exploring averting — from torpedoes, network-centric capabilities, naval gun solutions to submarines — with Germany," the source said.
"We will only know the outcome when Kumar returns later this week."

Da un articolo più ampio, intitolato "ANALYSIS: Leonardo eyes Asia-Pacific helicopter deals", pubblicato lo scorso 16 Agosto e che, a suo tempo, mi era sfuggito ..... ma che ho poi potuto leggere soltanto nei giorni scorsi nell' edizione cartacea di Flight International recapitatami con forte ritardo .....
In India, the company is interested in the country's maritime helicopter requirements.
The Sikorsky S-70B is apparently close to being confirmed as the winner of the 16-unit Maritime Reconnaissance Helicopter (MRH) contest.
A much larger prize, however, will be New Delhi’s planned Naval Multi-Role Helicopter competition for 120 rotorcraft, with the requirement covering anti-submarine and anti-surface warfare missions, as well as general transport duties.
Bortoli declines to specify which aircraft Leonardo will propose but the ASW-equipped AW101 Merlin would appear a likely candidate.
That said, Leonardo - more specifically Finmeccanica - and the AW101 have had a dismal few years in India.
After being selected for the government’s VVIP tender in 2009, in 2013 corruption allegations engulfed the acquisition, ultimately leading to the imprisonment of ex-Finmeccanica chief executive Giuseppe Orsi in early 2016.
Only three AW101s from the 12-unit order were delivered; Flight Fleets Analyzer lists these aircraft as being in storage since June 2013.
Bortoli, however, says the company has not been blacklisted in India: “We've never been officially blacklisted, and we've never received any communication.”
He adds that Leonardo has had “more than initial discussions” with an unspecified local firm in regard to potential production work in India.
This is a crucial initiative because of New Delhi’s obsession with developing its local defence industry.

Embraer has agreed to pay some $205 million to settle corruption charges involving sales of military and civil airplanes to four customers.
The agreements with the U.S. Department of Justice, the U.S. Securities and Exchange Commission (SEC), Brazil’s Ministério Público Federal (MPF) and the Brazilian Comissão de Valores Mobiliários (CVM) end a six-year graft probe that found that Embraer paid bribes and created false records to conceal illicit payments.
But further action could be taken against Embraer in India, concerning the acquisition of three EMB-145 aircraft for conversion to the AWACS role, suggested the Indian defense minister.

Finally, some $5.76 million allegedly went to an agent in India in connection with the sale of the three EMB-145s to the Indian Air Force (IAF).
Embraer falsely recorded those payments in its books and records as part of an illegitimate consulting agreement. Those aircraft received an indigenous radar system designed by the government’s Defense Research and Development Organization (DRDO).
The IAF is expected to receive the first one soon, but now favors longer-endurance and higher-altitude platforms for the AWACS mission.

Cambio di politica .....
India will not implement blanket blacklisting of foreign defense companies charged with corruption under a newly finalized policy that likely will be made public this month, said an Indian Ministry of Defence (MoD) official.
Since 2005, India has blacklisted six overseas companies from operating here in response to allegations of corruption while doing business in the country.
Instead of blocking a business from defense deals, India will impose an economic penalty on the company.

A former Indian air force chief, Air Chief Marshal Shashindra Pal Tyagi, was arrested on Friday by the Central Bureau of Investigation for alleged corruption in the purchase of 12 AW 101 VVIP helicopters from AgustaWestland, a subsidiary of Italy's Leonardo-Finmeccanica.
Along with Tyagi, Delhi based lawyer Gautam Khaitan and his cousin Sanjeev Tyagi also were arrested, "on the allegations accepting illegal gratification for exercising influence through corrupt and/or illegal means," according to the government.

L' è tutto sbagliato, l' è tutto da rifare !
Intercontinentale testa-coda giudiziario tra Italia e India: mentre l’India nei giorni scorsi arresta il proprio ex capo di Stato Maggiore dell’Aeronautica per le tangenti che Finmeccanica gli avrebbe pagato sino ad aprile 2012 in cambio del favore ad AgustaWestland nella gara per 12 elicotteri italiani da 560 milioni, nella medesima vicenda venerdì la Cassazione annulla (ordinando la celebrazione di un nuovo processo d’Appello) le condanne dell’ex amministratore delegato di Finmeccanica, Giuseppe Orsi (4 anni e mezzo), e dell’ex ad di AgustaWestland, Bruno Spagnolini (4 anni).
Condanne che nel 2015 la Corte d’Appello di Milano, nel processo istruito a Busto Arsizio dal pm Eugenio Fusco, aveva pronunciato per «corruzione internazionale» e «false fatturazioni» in relazione appunto ai pagamenti di almeno 10,5 milioni (tramite gli intermediari Guido Haschke e Christian Mitchell) alla «famiglia» del generale Sashi Tyagi.

The Indian government could overlook allegations of bribery by Rolls-Royce, according to a source in the Indian Ministry of Defence.
The British company would have to be prepared to assist India in its jet engine development program for future indigenous fighters, however.
Another MoD official was optimistic that "India will continue to do business with Rolls-Royce."
The statements come about five months after an internal report by the MoD concluded that Rolls-Royce paid bribes worth $75 million to secure orders for Adour Mk 871-07 aero engines for the Hawk advanced jet trainer aircraft being produced by Hindustan Aeronautics Limited under license from BAE Systems of the U.K.
In early January 2017, a British court ruled that Rolls-Royce has engaged middlemen to help the company secure defense contracts in India between 2005 and 2009 — a violation of Indian law.

Italy's Whitehead Sistemi Subacquei S.p.A., a subsidiary of Leonardo, might be reconsidered to supply Black Shark torpedoes for French Scorpene submarines currently being built in India, according to sources in the Indian Ministry of Defence.
This follows observations made by India's attorney general on the legality of issuing tenders and its subsidiary defence companies, which are facing probes on charges of alleged corruption.
In June of last year, MoD announced the cancellation of a $200 million deal for Black Shark torpedoes, but MoD sources said the tender was not formally cancelled and that no intimation of the cancellation was conveyed to the Italian company.

Dal momento che non sono ancora riusciti cavare il classico 'ragno dal buco' circa l'acquisto dei nuovi elicotteri navali ..... ora pensano di procurarsi, ad interim, un paio di dozzine di Sikorsky S-70B americani .....
After years of procrastination over selecting a new naval multi-role helicopter (MRH), the Indian Ministry of Defence may still make an interim purchase of up to 24 Sikorsky S-70B Seahawkss.
This follows repeated appeals by the Indian Navy to hasten the program, given the state of its aging and depleted Sea King fleet and its ambitions to become a "Blue Water Navy."
India recently issued a new request for information (RFI) for 123 MRHs to perform anti-submarine warfare (ASW), anti-surface warfare (ASuW), electronic intelligence-gathering, and search and rescue (SAR).
These helicopters would be procured and produced according to Delhi’s "Make in India" policy.

Former Union ministers Yashwant Sinha and Arun Shourie on Wednesday teamed up with activist-lawyer Prashant Bhushan to assert that the Rafale fighter aircraft deal was the “biggest defence scam ever”, and accused the BJP-led Centre of “compromising national security”.
The trio told a press conference here that the purchase of 36 Rafale jets from France is a “textbook case of criminal misconduct” by the government.
Shourie said the deal was a “scandal much bigger than Bofors” and needs an urgent forensic audit to fix accountability.
He said the secrecy clause in the agreement with France only binds India from revealing the technical specifications and operational capabilities of the aircraft, but does not restrain the government from disclosing the price.

Indian media reports indicate that investigations are underway into New Delhi’s May 2012 purchase of 75 Pilatus PC-7 Mk-II basic trainers.
The Central Bureau of Investigation (CBI) is apparently looking into corruption allegations related to the basic trainer aircraft contract worth approximately US$523 million, following the completion of a three-year inquiry into the deal.
Pilatus declined to comment when FlightGlobal asked about the matter.

This modification provides for the production and delivery of three MH-60R Seahawk maritime aircraft for the Navy and 21 MH-60Rs for the government of India.
Work will be performed at Owego, New York (52%); Stratford, Connecticut (40%); and Troy, Alabama (8%), and is expected to be complete by September 2024.
Fiscal 2020 aircraft procurement (Navy) funds in the amount of $113,100,000 and Foreign Military Sales funds in the amount of $791,700,000 will be obligated at time of award, none of which will expire at the end of the current fiscal year.
The Naval Air Systems Command, Patuxent River, Maryland, is the contracting activity.

Mi stupisco dello stupore...
In un contratto di fornitura di armamenti, e non solo, la qualità del prodotto è solo UNO degli aspetti che vengono presi in considerazione,
altrimenti quale sarebbe stato per l'AMI il senso di acquisire il G222 invece di altri C130 o l'AMX invece degli F116?
Ci sono accordi commerciali che vanno anche al di la dello specifico settore, e gli americani sono ovviamente molto più potenti di noi.
Per questo non credo che i 345 ed i 346 avranno successo commerciale...

E' da quel dì che, quando ci sono in mezzo gli Stati Uniti, non mi stupisco più di nulla ...
Basta ricordare quel che è successo al C-27J e al VH-71 ... e quel tempo non c'era la presente amministrazione che privilegia il "buy american" ... c'erano il ''buon' Obama, il senatore McCain e i generaloni sponsorizzati dalla Lockheed ...
Anzi ... sotto l'attuale amministrazione abbiamo visto il recente acquisto delle fregate FREMM e degli elicotteri da addestramento AW119 destinati alla Marina USA.
E, a proposito di Marina USA, sarà interessante vedere come andrà a finire questo programma che è ai suoi albori ...

Il problema e', se non salta fuori un'altra frittata tipo elicotteri, o tipo Rafale, con la storia che vogliono assemblarli localmente.....

L'India, alla luce delle difficoltà che trova in relazione all'approvvigionamento di determinati materiali militari, ha deciso, probabilmente obtorto collo, di togliere il bando a Leonardo ...
India on Friday lifted a ban on the Italian firm Leonardo from doing business with the Ministry of Defence.
The names of Leonardo S.p.A. and its subsidiary AgustaWestland International UK were dropped from the list of entities restricted from dealing with the ministry, an MoD official said.
AgustaWestland, however, no longer exists as a separate entity, having been completely wrapped up into Leonardo.
The Italian defense company can now resume business activities with the ministry on the condition that it doesn’t make monetary claims for previously signed agreements.
The MoD official said the suspension was lifted on the grounds of operational urgency and because of a lack of available alternatives for procuring 127mm naval guns and heavy-weight torpedoes.
